Dumb guy needs help understanding laws

Post by wizrd »

Does federal law prohibit anyone from shipping me an automatic knife -- to NY state -- upstate, not NY City. NY's Firearms and Weapons Laws states that I may possess an automatic knife when engaged in hunting or fishing.

Does federal law prohibit me from ordering one from out of state?

The reason I ask is that Benchmade has a form on their warranty page - called the "Automatic Knife Opening Acknowledgement Form" that seems to state they will NOT ship a knife to persons who do not fall into a certain employment or service category -- I don't seem to fall into any of the 5 categorys.
C'mon, help a dumb guy out here.

Like my Grandma used to tell me, "Keep a low profile - don't break more than one law at a time." ; )

"Federal law prohibits shipment of automatic knives across state lines, with the following exceptions:
(1) to civilian or Armed Forces supply or procurement officers and employees of the Federal Government ordering, procuring, or purchasing such knives in connection with the activities of the Federal Government; (2) to supply or procurement officers of the National Guard, the Air National guard, or militia of a State, Territory or the District of Columbia ordering, procuring, or purchasing such knives in connection with the activities of such organization; (3) to supply or procurement officers or employees of the municipal government of the District of Columbia or of the government of any State or Territory, or any county, city or other political subdivision of a State or Territory; (4) to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs (1), (2), and (3)."

That's interesting. I have ordered a couple autos from a well known site and had no problems in purchasing or having them delivered, here in Georgia. It was my understanding that it is a state by state kind of deal. Nor were there any stated rules or bylines that I had to adhere to. I am neither active military or law enforcement, just a knife nut. ::shrug::

I have no idea what the NY State laws are but it does seem like I have seen a list of states that certin knives could not be shipped to and I think it included NY as well as Ca. and a few others::shrug::

You can have them shipped in spite of the law but most will not ship to NY because of the stat laws that apply.
